OVERVIEW

Welcome to East West Atelier! In this document, "we", "us" and "our" refer to East West Atelier. East West Atelier runs this website and everything on it — the content, features, tools, products and services we use to give you, our customer, a curated shopping experience (the "Services"). We use Shopify's platform to power and deliver these Services to you.

The terms below, together with any policies they reference (this "Terms of Service" or "Terms"), set out your rights and obligations when using our Services.

Please take a moment to read through this carefully — it includes important information about your legal position, including how we limit our liability and disclaim certain warranties.

By visiting, browsing, or otherwise using our Services, you agree to these Terms and to our Privacy Policy. If you don't agree with either, please don't use our Services.

SECTION 1 – ACCESS AND YOUR ACCOUNT

By accepting these Terms, you confirm that you've reached the age of majority in your place of residence, and that you consent to any minors in your household using the Services on devices that you own or manage.

To use our Services — including browsing our store or placing an order — we may ask for information such as your email address, billing details, payment information, and shipping address. You confirm that whatever you provide us is accurate, current, and complete, and that you're entitled to share it.

You're responsible for keeping your account credentials secure and for everything that happens under your account. Your account may not be sold, transferred, or licensed to anyone else.

SECTION 2 – OUR PRODUCTS

We do our best to represent our products accurately on this site, but colors and details may look slightly different depending on your screen and device settings.

We can't guarantee that a product's look, feel, or quality will match your expectations or exactly mirror how it's shown online.

Product descriptions can change at any time without notice, at our discretion. We also reserve the right to discontinue a product, or to limit how much of it we sell to a particular customer, region, or market.

SECTION 3 – PLACING AN ORDER

Placing an order is you making us an offer to buy. We reserve the right to accept or decline that offer for any reason. An order isn't confirmed until we've accepted it and your payment has been received and processed. Please double-check your order before submitting it, since we may not be able to accommodate cancellation requests once it's been accepted. If we need to change, decline, or cancel your order, we'll try to reach you using the contact details you gave us at checkout.

Any returns or exchanges are handled under our separate Refund Policy.

You confirm that you're buying for your own personal or household use, and not to resell or export commercially.

SECTION 4 – PRICING AND PAYMENT

Prices, discounts, and promotions can change without notice. What you're charged is the price shown at the moment you place your order, as confirmed in your order confirmation email. All prices are shown in British pounds (GBP) and include VAT. Shipping within the United Kingdom is free.

Prices on this site may differ from prices we charge in physical locations or through other sales channels. From time to time we may run promotions with their own separate terms — if those conflict with this document, the promotion's terms apply.

You agree to keep your payment and account details accurate and up to date, so we can process your orders and reach you if needed.

You also confirm that any payment details you provide are genuine and that you're authorized to use them, that your card issuer will honor the charge, and that you'll pay the full posted price, including shipping and any applicable taxes.

SECTION 5 – SHIPPING

Delivery times we give are estimates, not guarantees, and we're not liable for delays — including delays caused by couriers, customs, or anything else outside our control. Your order remains our responsibility until it has been delivered to you, or to someone you have nominated to receive it. From that moment, responsibility for it (including risk of loss) passes to you.

SECTION 6 – INTELLECTUAL PROPERTY

Everything on our Services — trademarks, branding, text, layout, images, graphics, reviews, video and audio, and how it's all arranged — belongs to East West Atelier or our licensors, and is protected under applicable Dutch, EU, UK, and international copyright, trademark, and intellectual property law.

You're welcome to use our Services for your own personal, non-commercial purposes. Beyond that, you may not copy, distribute, modify, create derivative works from, publicly display or perform, republish, download, store, or transmit any part of our content without our written permission. Nothing here grants you any license or right under our (or Shopify's, or any third party's) patents, trademarks, or copyrights, except as explicitly stated. Using our content outside these limits may breach intellectual property law. We reserve every right not expressly given to you here.

Our name, logo, product names, and designs are trademarks belonging to East West Atelier and may not be used without our written permission. Shopify's own name, logo, and branding belong to Shopify. Any other names, logos, or branding appearing on our Services belong to their respective owners.

SECTION 7 – OPTIONAL THIRD-PARTY TOOLS

We may give you access to tools built by third parties, which we don't control or monitor.

These tools are provided "as is," without any warranty or endorsement from us, and we carry no liability for how you use them.

If you choose to use any optional third-party tool, that's entirely your own decision and risk — make sure you understand and accept that provider's own terms first.

We may add new features or tools to our Services over time; when we do, they become part of the Services and fall under these same Terms.

SECTION 8 – LINKS TO OTHER WEBSITES

Our Services may link out to websites or content run by third parties. We don't review or vouch for that external content, and if you click through to it, you do so at your own risk.

We're not responsible for any harm connected to third-party sites, or to anything you buy or use through them. Read a third party's own policies carefully before transacting with them — any issues with their products or service are between you and them.

SECTION 9 – OUR RELATIONSHIP WITH SHOPIFY

East West Atelier runs on Shopify's platform, which lets us deliver our Services to you. That said, whenever you buy something from us, that transaction is between you and East West Atelier directly — Shopify has no part in it. By using our Services, you agree that Shopify carries no responsibility for anything arising from your purchases with us, and you release Shopify and its affiliates from any related claims.

SECTION 10 – PRIVACY

Any personal information we collect through our Services is handled under our Privacy Policy, and some of it may also fall under Shopify's own Privacy Policy. By using our Services, you confirm you've had the chance to read both.

Because our Services run on Shopify's infrastructure, Shopify also processes data about how you use our site, to help us provide and improve it. Information you give us may be shared with Shopify and other providers, including ones located outside your own country, in order to deliver our Services. Our Privacy Policy has the full details.

SECTION 11 – YOUR FEEDBACK

If you send us ideas, suggestions, reviews, or other feedback ("Feedback"), you're giving us a permanent, worldwide, royalty-free right to use, adapt, publish, and share it however we see fit — including commercially — to help us run and improve our Services.

You also confirm that: you own the rights to whatever Feedback you send us, or have permission to share it; you've disclosed if you were compensated for it; and it complies with these Terms. We're under no obligation to keep your Feedback private, pay you for it, or respond to it.

We may (but don't have to) review, edit, or remove Feedback we consider unlawful, offensive, or otherwise inappropriate, or that infringes someone's rights.

You agree your Feedback won't infringe anyone else's rights, won't be defamatory, abusive, or unlawful, and won't contain malware. Don't use a fake identity or impersonate someone else when submitting Feedback. You're solely responsible for what you send us and whether it's accurate — we don't take responsibility for Feedback submitted by you or anyone else.

SECTION 12 – MISTAKES AND CORRECTIONS

Every so often, something on our site — a product description, a price, an offer, a shipping estimate — might contain an error. We reserve the right to fix these at any time, and to change, update, or cancel affected orders, even after you've already placed one.

SECTION 13 – ACCEPTABLE USE

You may only use our Services lawfully. That means not using them, directly or indirectly, to: break any law or regulation; infringe our or anyone else's intellectual property; harass, abuse, or defame anyone, including our staff; spread false or misleading information; send spam, chain letters, or unsolicited marketing; impersonate someone else; or otherwise interfere with anyone else's ability to use or enjoy our Services, or expose us or others to liability.

You also agree not to: upload viruses or malicious code; copy, resell, or exploit any part of our Services without permission; harvest others' personal data; scrape, crawl, or use bots against our site; or try to bypass our security measures. We may suspend or close your account at any time, without notice, if we believe you've broken these rules.

SECTION 14 – ENDING THIS AGREEMENT

We may end this agreement, or cut off your access to our Services, at our discretion and without notice. You'll remain responsible for any outstanding amounts owed up to that point.

Certain sections continue to apply even after termination — including those covering Intellectual Property, Feedback, Disclaimers, Limitation of Liability, Indemnification, Severability, Governing Law, and anything else that by its nature should survive.

SECTION 15 – NO WARRANTY

Content on our Services is provided for general informational purposes only. We don't guarantee it's accurate, complete, or useful, and any reliance you place on it is at your own risk.

Except where we say otherwise, our Services and products are provided "as is" and "as available," without warranties of any kind — including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't promise that our Services will always be available, timely, secure, or error-free. Some jurisdictions don't allow these kinds of disclaimers, so parts of this section may not apply to you.

SECTION 16 – LIMITATION OF LIABILITY

To the extent the law allows, East West Atelier, our staff, partners, and affiliates — and Shopify's — won't be liable for any indirect, incidental, punitive, or consequential damages arising from your use of our Services or products, including lost profits, lost data, or similar losses, however they're claimed to have arisen, even if we were warned they were possible.

SECTION 17 – YOU INDEMNIFY US

You agree to cover us, Shopify, and our respective affiliates, staff, and partners for any losses, damages, or claims — including reasonable legal fees — that arise because you breached these Terms, broke the law, infringed someone's rights, or misused our Services.

We'll let you know if a claim like this comes up; failing to notify you promptly won't excuse your obligations unless it genuinely harmed your position. We may take over the defense of such a claim at your expense, though we won't settle in a way that imposes non-monetary obligations on you without your (reasonable) consent. You agree to cooperate with us on this, including by providing relevant information.

SECTION 18 – IF PART OF THIS AGREEMENT ISN'T ENFORCEABLE

If any part of these Terms turns out to be unlawful or unenforceable, that part will be enforced as far as legally possible, and the rest of the agreement stays fully in effect.

SECTION 19 – NOT WAIVING OUR RIGHTS; THE FULL AGREEMENT

If we don't act on a right under these Terms at some point, that doesn't mean we've given it up.

These Terms, together with any policies we've posted, form the entire agreement between you and us regarding our Services, replacing any earlier discussions, agreements, or versions of these Terms.

Ambiguities in this document won't automatically be read against whoever drafted it.

SECTION 20 – TRANSFERRING THIS AGREEMENT

You can't transfer your rights or obligations under this agreement to someone else without our written consent. We, however, may transfer or assign this agreement freely, without needing your consent or having to notify you.

SECTION 21 – GOVERNING LAW

These Terms, and any related agreements under which we provide you our Services, are governed by the laws of the Netherlands. If you are a consumer living in the United Kingdom, this choice of law does not take away the protection of the mandatory consumer laws of the part of the UK where you live, including the Consumer Rights Act 2015, and you may bring proceedings in the courts of England and Wales, Scotland or Northern Ireland, depending on where you live. If you are a consumer living in the European Union, you likewise keep the protection of the mandatory consumer laws of your country of residence.

The headings in this document are there for convenience only and don't affect how the Terms are interpreted.

SECTION 23 – CHANGES TO THESE TERMS

Last updated: September 28, 2026

We may update these Terms from time to time by posting the revised version on this page. We'll flag any material changes as required by law, and those changes take effect on the date we specify. If you keep using our Services after an update, that means you accept the new Terms.
